美国最高法院或就特朗普限制出生公民权行政命令作出裁决

美国最高法院可能将在星期五(6月27日),就总统特朗普试图广泛执行其限制出生公民权的行政命令作出裁决。

路透社报道,特朗普政府已经向最高法院紧急申请,要求限制马里兰州、华盛顿特区和马萨诸塞州联邦法官对这项行政命令发出的禁令。这些法官此前裁定,特朗普签署的行政命令很可能违反美国宪法第十四修正案中有关公民身份的条款。

特朗普在今年1月签署的行政命令中称,他会用与以前的不同方式解释宪法第十四修正案,称其“从未被解释为将公民身份普遍扩大到所有在美国境内出生的人”。

这项命令意味着,如果父母在孩子出生时未获准在美国居留,即父母中没有一人为美国公民或合法永久居民,那么孩子将不会被授予美国国籍。

根据提出诉讼的原告称,如果特朗普的行政命令落实,每年将有超过15万名新生儿被剥夺公民身份。原告包括美国22州的民主党籍总检察长、移民权益倡导者,以及一些怀孕移民等。

原告方指出,特朗普的行政命令违反美国宪法第十四修正案。第十四修正案中的公民条款明确规定:“凡在美国出生或归化,并受其管辖之人,皆为美国及其所居住州之公民。”

特朗普政府则主张,第十四修正案虽长期被理解为赋予几乎所有在美国出生者以公民身份,但不应适用于非法移民,甚至不应适用于合法但临时居留者,如持学生签证或工作签证的移民。

另据路透社/益普索(Ipsos)于6月11日至12日进行的一项民调显示,仅24%受访者支持终止出生公民权,52%表示反对。

Should You Buy Bitcoin?

In general, many financial experts support their clients’ desire to buy cryptocurrency, but they don’t recommend it unless clients express interest. “The biggest concern for us is if someone wants to invest in crypto and the investment they choose doesn’t do well, and then all of a sudden they can’t send their kids to college,” says Ian Harvey, a certified financial planner (CFP) in New York City. “Then it wasn’t worth the risk.” The speculative nature of cryptocurrency leads some planners to recommend it for clients’ “side” investments. “Some call it a Vegas account,” says Scott Hammel, a CFP in Dallas. “Let’s keep this away from our real long-term perspective, make sure it doesn’t become too large a portion of your portfolio.” In a very real sense, Bitcoin is like a single stock, and advisors wouldn’t recommend putting a sizable part of your portfolio into any one company. At most, planners suggest putting no more than 1% to 10% into Bitcoin if you’re passionate about it. “If it was one stock, you would never allocate any significant portion of your portfolio to it,” Hammel says.

How Does Bitcoin Work?

Bitcoin is built on a distributed digital record called a blockchain. As the name implies, blockchain is a linked body of data, made up of units called blocks that contain information about each and every transaction, including date and time, total value, buyer and seller, and a unique identifying code for each exchange. Entries are strung together in chronological order, creating a digital chain of blocks. “Once a block is added to the blockchain, it becomes accessible to anyone who wishes to view it, acting as a public ledger of cryptocurrency transactions,” says Stacey Harris, consultant for Pelicoin, a network of cryptocurrency ATMs. Blockchain is decentralized, which means it’s not controlled by any one organization. “It’s like a Google Doc that anyone can work on,” says Buchi Okoro, CEO and co-founder of African cryptocurrency exchange Quidax. “Nobody owns it, but anyone who has a link can contribute to it. And as different people update it, your copy also gets updated.”
