🛑مسئولیت مالک زمین به جبران خسارت ثالث ناشی از اعمال پیمانکار ساختمانی
✅ چنانچه در اثر عملیات احداث بنا و خاک برداری خسارت به املاک مجاور وارد شود، مالک آن در قبال زیان دیدگان مسئولیت به جبران خسارت دارد هر چند که خسارت ناشی از اعمال پیمانکار ساختمان باشد که بر اساس قرارداد به اعمال خسارت بار پرداخته باشد. روابط بین مالک و پیمانکار بر اساس اصل نسبی بودن قرارداد محدود به طرفین قرارداد است و قابل استناد علیه اشخاص ثالث نیست. مالک پس از جبران خسارت حق دارد بر اساس روابط فی مابین و شروط قراردادی برای پس گرفتن خسارت پرداختی به پیمانکار مراجعه نماید.
