深圳市中院认为，童道驰受贿论罪应处死刑；鉴于其到案后能够如实供述罪行、主动交代办案机关尚未掌握的大部分受贿事实及内幕交易事实，内幕交易罪构成自首，认罪悔罪积极退赃；受贿所得赃款赃物及内幕交易的非法所得已全部追缴，具有法定酌定的从轻或者减轻情节，对其所犯受贿罪判处死刑可不立即执行，对其所犯内幕交易罪可从轻处罚。
